1. Agreement to these Terms

These Terms of Service govern access to and use of ZipScore, a scoring and event administration platform developed and hosted by Stack Builders for U.S. Ski & Snowboard and related ski and snowboard events.

By accessing or using the platform, you agree to these Terms. If you access the platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms or that your organization has entered into a separate written agreement with Stack Builders or an authorized customer.

If a separate written agreement between Stack Builders and a customer applies to the platform, that agreement controls if it conflicts with these Terms.

2. Roles

The platform may be used by different types of users, including:

  • Event organizers and competition administrators
  • Judges, officials, technical delegates, jury members, timers, and scoring personnel
  • Clubs, teams, coaches, and schools
  • Athletes, parents, and guardians
  • Sanctioning bodies, governing bodies, or ranking administrators
  • Public viewers of live or final results
  • Stack Builders personnel providing hosting, maintenance, security, and support

Customers are responsible for deciding which users may access the platform and what roles or permissions they receive.

3. Platform purpose

The platform is designed to support event administration and scoring workflows, including start lists, score entry, score calculation, result publication, audit records, and related support functions.

The platform is a technology tool. It does not replace the authority of event officials, juries, technical delegates, sanctioning bodies, governing bodies, or applicable competition rules. Official results, protests, corrections, appeals, eligibility decisions, sanctions, and rankings remain subject to the applicable event rules and decisions of authorized officials.

4. Eligibility and account registration

You may use the platform only if you are authorized to do so by Stack Builders, a customer, an event organizer, a governing body, or another authorized administrator.

You agree to provide accurate account information and to keep it current. You may not impersonate another person, create an account using false information, or access the platform if your access has been suspended or revoked.

Minors may access the platform only as permitted by the relevant customer, event organizer, parent or guardian, and applicable law. Customers are responsible for determining whether parental or guardian consent is required.

5. Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must promptly notify Stack Builders or the relevant customer if you suspect unauthorized access, credential compromise, or improper use of the platform.

You may not share administrator, judge, official, or scoring credentials with unauthorized users. Customers should promptly remove access for users who no longer need it.

6. Authorized use

You may use the platform only for lawful event administration, scoring, judging, result publication, support, and related purposes authorized by Stack Builders or the applicable customer.

You agree not to:

  • Access or use the platform without authorization
  • Interfere with scoring, judging, timing, result publication, or audit functions
  • Enter false, misleading, or unauthorized scores or event data
  • Attempt to bypass role-based permissions or security controls
  • Scrape, crawl, harvest, copy, or bulk download data except as expressly authorized
  • Reverse engineer, decompile, or attempt to derive source code except as permitted by law
  • Upload malware, malicious code, or harmful files
  • Probe, scan, or test platform vulnerabilities without written authorization
  • Use athlete or minor information for advertising, marketing, profiling, harassment, or unrelated commercial purposes
  • Harass, threaten, abuse, defame, or intimidate athletes, officials, coaches, administrators, or other users
  • Violate event rules, governing-body rules, SafeSport-related obligations, privacy laws, or other applicable laws

7. Event data and customer responsibilities

Customers are responsible for the event, athlete, participant, scoring, and administrative data they enter into or cause to be processed by the platform. Customers are responsible for ensuring that they have the rights, notices, consents, and legal bases needed to process that data.

Customers and authorized users should enter only information that is accurate, necessary, appropriate, and lawful. They should avoid entering unnecessary sensitive information, including full birthdates, home addresses, medical information, emergency contact information, payment information, private identifiers, or other sensitive data unless specifically required and authorized.

Customers are responsible for configuring user permissions, public result settings, data retention instructions, correction procedures, and official result workflows.

8. Scores, results, and official decisions

The platform may display live, provisional, corrected, and final scores or results. Live or provisional information may be incomplete, delayed, inaccurate, or subject to correction.

Official results become final only when designated as final by authorized event officials or under the applicable event rules. Stack Builders does not independently verify athletic performance, judging decisions, eligibility, ranking calculations, sanctions, protests, or appeals unless expressly agreed in writing.

Any challenge to a score, ranking, disqualification, result, eligibility determination, or event decision must be made through the applicable event, sanctioning-body, or governing-body process. Support requests to Stack Builders are for technical issues and do not replace official competition procedures.

9. Audit logs and corrections

The platform may maintain audit logs of user actions, score entries, edits, approvals, publication events, timestamps, IP addresses, and related metadata. These logs are used to support score integrity, security, troubleshooting, compliance, and dispute resolution.

Stack Builders may preserve audit logs and related records as needed to operate the platform, comply with customer instructions, respond to legal or security issues, and maintain the integrity of scoring workflows.

10. Public results

Customers may configure the platform to publish event results publicly or to limited audiences. Published results may include athlete names, bib numbers, clubs, teams, categories, scores, rankings, placements, event status, and related competition details.

Public results may be copied, shared, indexed, archived, or republished by third parties. Stack Builders is not responsible for third-party use of public results after they are made available outside the platform.

11. Privacy

Use of the platform is also governed by the Privacy Policy and Cookie and Tracking Notice. Customers and authorized users must comply with those documents and with any applicable privacy, child protection, data protection, and event-participant notice obligations.

Stack Builders generally processes event and athlete data as a processor/service provider on behalf of customers. Customers are responsible for responding to privacy requests when they control the data, and Stack Builders will assist as required by contract and applicable law.

12. Intellectual property

Stack Builders and its licensors own the platform, including software, designs, interfaces, workflows, documentation, trademarks, service marks, logos, and other technology or content provided by Stack Builders.

Subject to these Terms and any applicable written agreement, Stack Builders grants authorized users a limited, revocable, non-exclusive, non-transferable right to access and use the platform solely for authorized event administration, scoring, judging, result publication, and support purposes.

No rights are granted except as expressly stated. You may not copy, modify, distribute, sell, lease, host, sublicense, or create derivative works from the platform except as authorized in writing.

13. Customer and user content

Customers and users may submit event data, athlete data, scores, notes, files, logos, names, or other content to the platform. As between Stack Builders and the customer, ownership of customer-provided content remains with the customer or its licensors.

Customers grant Stack Builders a limited license to host, process, transmit, display, reproduce, back up, and otherwise use customer-provided content only as needed to provide, secure, maintain, improve, and support the platform, comply with customer instructions, and fulfill legal obligations.

Customers and users represent that they have the rights and authority needed to submit content to the platform and to allow Stack Builders to process it as described in these Terms and the Privacy Policy.

14. Feedback

If you provide suggestions, ideas, bug reports, or feedback, Stack Builders may use them without restriction or compensation, provided that Stack Builders will not publicly identify you as the source of feedback without permission.

15. Third-party services and integrations

The platform may interoperate with third-party services, including hosting providers, authentication tools, payment processors, event registration systems, email or messaging providers, analytics tools, timing systems, scoring devices, sanctioning-body systems, or public result feeds.

Third-party services may be governed by their own terms and policies. Stack Builders is not responsible for third-party services unless expressly stated in a written agreement.

16. Suspension and enforcement

Stack Builders or the applicable customer may suspend, restrict, or terminate access to the platform if a user violates these Terms, threatens platform security or integrity, misuses athlete or event data, interferes with scoring or event operations, or creates legal, operational, or safety risk.

Stack Builders may remove or restrict content when required by law, customer instruction, security needs, or platform integrity concerns.

17. Availability and changes

Stack Builders will use commercially reasonable efforts to provide a reliable platform, subject to any applicable written agreement. The platform may be unavailable due to maintenance, updates, internet outages, third-party service failures, security events, force majeure events, or other circumstances.

Stack Builders may modify, improve, suspend, or discontinue features from time to time. Material changes for contracted customers should be handled according to the applicable written agreement.

18. Disclaimers

The platform is provided “as is” and “as available” unless a separate written agreement states otherwise. To the fullest extent permitted by law, Stack Builders disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and error-free operation.

Stack Builders does not warrant that scores, results, rankings, event data, or public pages will be accurate, complete, uninterrupted, final, or free from correction. Customers and authorized officials are responsible for reviewing and approving official results.

19. Limitation of liability

To the fullest extent permitted by law, Stack Builders will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of goodwill, loss of data, business interruption, event cancellation, ranking impacts, qualification impacts, or reputational harm, even if advised of the possibility of such damages.

To the fullest extent permitted by law, Stack Builders' total liability arising out of or relating to the platform or these Terms will not exceed the greater of: (a) the amounts paid to Stack Builders for the platform by the applicable customer in the three months before the event giving rise to the claim; or (b) $1,000. This limitation does not apply where prohibited by law or to obligations that cannot be limited under an applicable written agreement.

20. Indemnification

To the fullest extent permitted by law, customers and users agree to defend, indemnify, and hold harmless Stack Builders and its officers, directors, employees, contractors, agents, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or relating to:

  • Misuse of the platform
  • Violation of these Terms
  • Unauthorized access or credential sharing
  • Customer-provided data or content
  • Violation of privacy, child protection, sport-governance, SafeSport-related, or other legal obligations
  • Official scoring, ranking, eligibility, protest, appeal, or event decisions controlled by customers or governing bodies

This section should be harmonized with any separate written agreement between Stack Builders and a customer.

21. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, unless a separate written agreement states otherwise.

Subject to any separate written agreement, the state and federal courts located in Monroe County, New York will have exclusive jurisdiction over disputes arising from these Terms or the platform, and each party consents to personal jurisdiction in those courts.

22. Changes to these Terms

Stack Builders may update these Terms from time to time. The updated version will be posted with a new effective date. Material changes may also be communicated through the platform, by email, or through customer communications where appropriate.

Continued use of the platform after updated Terms become effective means you accept the updated Terms.
